2. About This Website
This website is operated by Sve Pod Suncem, LLC d/b/a Suncem Collection ("we," "us," or "our") for the purpose of providing information about properties in the Suncem Collection portfolio and facilitating direct reservations. Each property in the Suncem Collection is owned and operated by its respective ownership entity, as identified in the Short-Term Rental Agreement applicable to that property.
3. Reservations and Rental Agreement
Completing a reservation through this website constitutes an agreement to enter into a binding Short-Term Rental Agreement with the applicable property ownership entity. The full terms and conditions governing your stay — including, but not limited to, property rules, occupancy limits, cancellation policy, damage policy, and all other guest obligations — are set forth in the Short-Term Rental Agreement, which will be provided to you following booking and must be signed prior to check-in.
In the event of any conflict between these Terms of Use and the Short-Term Rental Agreement, the Short-Term Rental Agreement controls with respect to your stay at the property.
4. Accuracy of Information
The information on this website — including property descriptions, amenity details, availability, and pricing — is provided for general informational purposes only. Sve Pod Suncem, LLC makes no warranty that such information is error-free, complete, or current. Pricing and availability are subject to change without notice until a reservation is confirmed. Property descriptions are provided by or on behalf of the applicable property ownership entity, and any claims arising from property conditions or amenity representations are governed exclusively by the applicable Short-Term Rental Agreement. 5. Intellectual Property
All content on this website — including text, photographs, graphics, logos, and the Suncem Collection brand — is owned by or licensed to Sve Pod Suncem, LLC and is protected by applicable copyright and trademark laws. To the fullest extent permitted by applicable law, Sve Pod Suncem, LLC, its affiliated property ownership entities, and their respective members, managers, officers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website or your inability to access it. The aggregate total liability of Sve Pod Suncem, LLC and all affiliated property ownership entities, collectively, for any claim or claims arising from your use of this website or any reservation facilitated through it shall not exceed the total reservation amount paid by you through this website for the stay giving rise to the claim. This aggregate cap applies regardless of the number of entities named, claims asserted, or theories of liability pursued.
Nothing in these Terms of Use limits the liability of the applicable property ownership entity for death or personal injury occurring at the property caused by negligence, or for fraud. Claims of this nature are governed exclusively by the Short-Term Rental Agreement applicable to your reservation and applicable law, and are subject to the insurance maintained by the applicable property ownership entity.
